Summary:

The plaintiff and her family sued a doctor, alleging medical malpractice relating to an operation to remove two ingrown toenails. Following surgery, a bone infection set into the right toe which did not respond to treatment, and ultimately the toe was amputated back to the first joint. The plaintiff alleged that the doctor was negligent in failing to fully inform the plaintiff as to the options available to her to deal with her ingrown toenails, and failed to advise her of the risk of infection associated with the surgery.

The Ontario Court (General Division) dismissed the action, but provisionally assessed $30,000 nonpecuniary general damages.
