(Action No. 9303-14355)

Indexed As: Kelly v. Lundgard et al.

Alberta Court of Queen's Bench

Judicial District of Edmonton

Veit, J.

July 2, 1996.

Summary:

A patient sued two doctors, alleging that as a result of their negligent misrepresentations, which did not identify infertility as a possible result of her peritonitis and related surgery, she settled a motor vehicle action for considerably less than she would otherwise have done.

The Alberta Court of Queen's Bench allowed the action.

Fraud and Misrepresentation - Topic 2508

Misrepresentation - General principles - Negligent misrepresentation - A passenger sued for damages resulting from a motor vehicle accident - Medical reports from two doctors did not identify infertility as a possible result of her injuries - The passenger settled her action - The passenger subsequently discovered that she was infertile as a result of the accident - The passenger sued the doctors, alleging that as a result of their negligent misrepresentations, she settled the action for considerably less than she would otherwise have done - The Alberta Court of Queen's Bench allowed the action - The doctors knew that the passenger suffered from adhesions and adhesions could cause infertility - Infertility was a grave risk and the doctors were bound to identify it as one of the possible risks in the passenger's situation - The doctors failed to meet that standard.

Fraud and Misrepresentation - Topic 2563

Misrepresentation - Representations - Opinions - [See Fraud and Misrepresentation - Topic 2508 ].

Medicine - Topic 3082

Relation with patient - Charts, records, opinions and reports - Standard of care - The Alberta Court of Queen's Bench stated that "[t]he 'informed consent' standard applies to physicians who prepare medico-legal opinions. When preparing a medical-legal report including a prognosis, a physician must inform a lawyer about the major known risks of the condition or operation or illness or disease and must also inform the lawyer about those risks that are less common but are very grave if they do occur." - See paragraph 2.
