Summary:
The applicant applied to, inter alia, rescind child and spousal support arrears.
The Saskatchewan Court of Queen's Bench, Family Law Division, refused to rescind the arrears but suspended enforcement of arrears for 12 months.

Divorce - Corollary relief - Maintenance - Enforcement - Payment or cancellation of arrears of maintenance - After the parties divorced, Kulyk paid child and spousal support of $900/month including an amount for arrears - In November 1996, he was sentenced to one year's incarceration - He had no income thereafter - His driver's license in Alberta was suspended due to maintenance arrears - He needed his license for his work - He applied, inter alia, to rescind child and spousal support arrears - The Saskatchewan Court of Queen's Bench, Family Law Division, refused to rescind the arrears but suspended enforcement for 12 months - The court stated that Kulyk's incarceration for a year was not a special circumstance and his present inability to pay arrears did not justify a variation order - See paragraphs 3 to 6.
