Summary:

The plaintiffs, owners of Wilson's Original Equipment Manufacturer ("O.E.M.") Cross Reference Guide, sued the defendant for copyright infringement. The plaintiffs sought an interlocutory injunction restraining the defendant from continuing to use, distribute and/or publish its O.E.M. Cross Reference Guide until the infringement action was determined.

The Federal Court of Canada, Trial Division, dismissed the application.

Interlocutory or interim injunctions - Circumstances when injunction will not be granted - The plaintiffs, owners of Wilson's Original Equipment Manufacturer ("O.E.M.") Cross Reference Guide, sued the defendant for copyright infringement - They sought an interlocutory injunction restraining the defendant from continuing to use, distribute and/or publish its O.E.M. Cross Reference Guide until the infringement action was determined - The Federal Court of Canada, Trial Division, dismissed the application - The court agreed that there was a serious issue to be tried (copyright infringement), however, it held there was no evidence that the alleged infringement caused the plaintiffs irreparable harm not compensable in damages - Likewise, there was no evidence that the balance of convenience lay with the plaintiffs.
