Summary:

Pursuant to Regulations under the Health Services Insurance Act, the Manitoba Health Services Commission refused to pay for abortions performed at a clinic. The clinic applied for a declaration that the regulation was invalid on several grounds.

The Manitoba Court of Queen's Bench, in a decision reported at 82 Man.R.(2d) 64, declared the regulation invalid. The Manito­ba Government and the Health Services Commission appealed. The clinic cross-appealed, raising again the other grounds of attack not dealt with by the trial judge.

The Manitoba Court of Appeal, Scott, C.J.M., and Lyon, J.A., dissenting, dismissed the appeal.
