Summary:
The applicants applied for a declaration that the Province of Manitoba be required to pay the costs of abortions performed in the Morgentaler Clinic. The respondents brought an interlocutory motion to determine the admissibility of certain statements contained in the affidavits in support of the application.
The Manitoba Court of Queen's Bench ruled that, although the affidavits contained hearsay and argument, the objectionable portions could simply be ignored at the hearing of the application.
