Summary:
The plaintiff sued the defendant for damages for assault and battery arising from an incident at a house party.
The Yukon Territory Supreme Court, in a decision reported [2013] Yukon Cases Uned. (SC) 9, dismissed the plaintiff's claim. The plaintiff appealed.
The Yukon Court of Appeal, in a decision reported [2014] B.C.A.C. Uned. 1, dismissed the appeal. Before the order dismissing the appeal was entered, the plaintiff applied to re-open her appeal to consider fresh evidence which she claimed demonstrated that a significant witness at trial committed perjury in his testimony.
The Yukon Court of Appeal dismissed the fresh evidence application. The court held that the fresh evidence did not satisfy the criterion of being reasonably capable of belief. Furthermore, if believed, the evidence could not reasonably be expected to have affected the result of the trial.
