This action was heard on July 8-12, 15-19 and 22-25 and September 9-11, 2002, before Stinson, J., of the Ontario Superior Court. In addition, between July 25 and September 9, 2002, the plaintiff filed seven separate written submissions and subsequent to the trial, on September 24, 2002, a further 73 page written submission to supplement his oral reply. Counsel for the defendant submitted a written memorandum of law during the course of closing argument. On January 13, 2003, the following decision was released.
