Summary:

The Hours of Business Bylaw of the City of Red Deer (Bylaw No. 2870/85) restricted the commercial activities of retail sales businesses in the city, with certain exceptions, to specific hours each day with closure on Sunday, unless the business establishment closed to the public for a period of 24 consecutive hours in one of the six days immediately following Sunday. The plaintiffs were major retail sales businesses in the City of Red Deer. They operated on the basis of a seven day work week. The plaintiffs alleged that the bylaw would require them to be closed one day each week and probably Sunday. The plaintiffs commenced an action for a declaration that the bylaw was ultra vires the Municipal Government Act, was uncertain and contrary to the Canadian Charter of Rights and Freedoms ss. 2(a) and 15.

The Alberta Court of Queen's Bench allowed the action in part. The court held that the bylaw was valid except for certain portions which the court found were void for uncertainty. The court was able to sever the uncertain sections to perserve the balance of the bylaw. The court held that the bylaw was not contrary to the freedom of religion guarantee in the Charter, s. 2(a). The court held further that the plaintiffs being corporations and not individuals, were not protected by s. 15 of the Charter. The court also held that the corporations lacked standing to challenge the validity of the bylaw under s. 52 of the Charter, because there were other ways the issues raised could be presented to the court (i.e. by individuals affected by the legislation).
