Summary:

A psychiatric patient at a hospital applied to a review panel set up under the Mental Health Act to have cancelled admission renewal certificates issued by doctors pursuant to the Act. The renewal certificates gave the hospital authority to observe, examine, care for, treat, control and detain the patient. The review panel dismissed the patient's application and refused to cancel the renewal certificates. The patient appealed under s. 32(1) of the Act.

The Alberta Court of Queen's Bench allowed the appeal, quashed the decision of the review panel and cancelled the renewal certificates.
