Summary:

The plaintiff sued the defendant lawyer, alleging that he was liable for professional negligence or breach of contract in the manner he handled a share purchase agree­ment made by the plaintiff.

The Nova Scotia Supreme Court held that the plaintiff and the lawyer were equally responsible for the plaintiff's loss.

Negligence - Particular negligent acts - Re purchase of business by client - The plaintiff made arrangements to purchase shares in an automobile dealership in two stages - Before the transfer of shares was completed, the automobile manufacturer discontinued the franchise for lack of notice of an earlier share transfer - The plaintiff sued his lawyer, alleging that he was liable for professional negligence or breach of contract in failing to review the dealership agreement and telling him of the notice requirements - The Nova Scotia Supreme Court held that the lawyer failed to meet the standard of care in failing to review the dealership agreement, but the plaintiff was equally at fault because he ignored the advice of his accountant to notify the manufacturer of his purchase of the shares.
