Summary:

A man died and left an estate of approximately $640,000.00. By will he set up a $100,000.00 trust fund for his widow with income payable to the widow for life. In addition all personal affects and automobiles were to be transferred to the widow. The widow applied for "proper support" under the Succession Law Reform Act. The trial judge allowed the application in part - See 39 O.R.(2d) 263. The widow appealed.

The Ontario Divisional Court dismissed the appeals subject to a variation - See 39 O.R.(2d) 609. The widow appealed.

The Ontario Court of Appeal dismissed the appeal.
