Résumé:
The New Brunswick Court of Queen's Bench held the defendant, motorcycle driver grossly negligent and 100% at fault for the death of a gratuitous passenger. The motor cycle was in collision with a motor vehicle at an intersection.
The New Brunswick Court of Queen's Bench awarded the estate of the deceased passenger $465 for funeral expenses but dismissed the estate's claim for general damages for death because of the failure of the plaintiff to prove a reasonable probability of pecuniary loss resulting from the death of the gratuitous passenger who was a 16 year old girl about to be married.
