Personal injuries and death - Psychological injuries - Personality change - A 52 year old married woman, who worked as a waitress, suffered extensive bruising, undisplaced fracture of nose, fracture of rib and knee abrasions - Hospitalization not required - Traumatic arthritis of knees - Resulting psychotic depressive reaction for a time - Residual personality change from being happy and outgoing to being depressed, nervous and withdrawn - Moderate permanent disability - The New Brunswick Court of Queen's Bench, Trial Division, assessed $45,000 general damages for personal injuries - See paragraphs 1 to 9 and 13 to 18.

Negligence - Motor vehicle - Passengers - Contributory negligence of passenger - Failure to use safety equipment - The driver and passenger of a car, who were not wearing available shoulder and lap belts, were injured in a collision - It was proved that their injuries would have been less severe, if they had used the safety equipment - The New Brunswick Court of Queen's Bench, Trial Division, reduced their nonpecuniary damages by 15% because of their contributory negligence in failing to use the safety equipment - The Court of Queen's Bench discussed contributory negligence for failure to use safety equipment - The Court of Queen's Bench approved a judgment of Lord Denning in Froom v. Butcher, [1975] 3 All E.R. 520, in which he held that the failure to use safety equipment should reduce a passenger's damages from 0% to 25%, depending upon the effect which wearing the safety equipment would have had on injuries - See paragraphs 20 to 26.
