Summary:
The city of Montreal passed a bylaw raising the annual special tax on parking grounds from $0.01 to $0.12 dollars a square foot. Various commercial parking lots brought an action to quash the bylaw. The Quebec Superior Court in a judgment reported [1976] C.S. 63 quashed the bylaw on the ground that it was not promulgated as required and was ultra vires. The city appealed. The Quebec Court of Appeal dismissed the appeal on the ground that the tax on parking ground was required to be in a fixed amount. The city appealed.
The Supreme Court of Canada dismissed the appeal and affirmed the judgment of the Court of Appeal.
