Summary:

The Registrar of Indian Affairs found that Moses was entitled to registration as an Indian under s. 6(2) of the 1985 Indian Act. Moses applied for judicial review and sought to test certain provisions of the 1970 Indian Act. The Crown moved to strike out the application on the ground that there was no decision which the court could review under s. 18.1 of the Federal Court Act.

A Prothonotary of the Federal Court of Canada, Trial Division, granted the motion and struck out the application.

Registration - Appeals or judicial review - The Registrar of Indian Affairs found that Moses was entitled to registration as an Indian under s. 6(2) of the 1985 Indian Act - Moses applied for judicial review and sought to test certain provisions of the 1970 Indian Act - The Crown moved to strike out the application, arguing that there was no decision which the court could review under s. 18.1 of the Federal Court Act - A Prothonotary of the Federal Court of Canada, Trial Division, struck out the application - A determination by the Registrar under s. 5(3) of the Indian Act that a name be added or deleted from the Register was not finally determinative of a substantive right - The Prothonotary held that the Registrar's determination should not be reviewed at this point, but rather should be reviewed after a protest from Moses and a final and reviewable decision was made by the Registrar under s. 14 of the Indian Act.
