Injury and death - Head injuries - Brain damage - The plaintiff was injured in a motor vehicle accident - The New Brunswick Court of Queen's Bench, Trial Division, found, inter alia, that the now 46 year old plaintiff suffered serious bodily injuries as a result of the accident, including a mild traumatic brain injury, and that his present impairments would likely persist; the mild traumatic brain injury led to a severe decline in his ability to perform the essential duties of his occupation; his men's wear store was suffering financially before the accident and would have ceased operating even if his injuries had not occurred; and he was not capable of achieving any future employment income due to his injuries - The court assessed damages totalling $775,921.09, including $125,000 general damages, $15,300 for past loss of earnings and $585,000 for loss of earning capacity (based on a retail manager's salary of $40,000 annually, to age 65, less a 2.5% discount rate).
