Summary:

A regional manager cancelled two timber sale harvesting licences held by Omineca. Omineca appealed unsuccessfully to the chief forester. Omineca appealed under s. 156(2) of the Forest Act to an Appeal Board. Omineca made a preliminary objection to the presence of counsel for the Board, which was overruled. Omineca appealed to the Supreme Court under s. 156(8) of the Act and by way of petition under the Judicial Review Procedure Act.

The British Columbia Supreme Court dismissed the petition for review. Omineca appealed.

The British Columbia Court of Appeal, McEachern, C.J.B.C., dissenting, dismissed the appeal.

Natural justice - Constitution of board or tribunal - Bias - Apprehension of - The appellant complained that an Appeal Board, appointed under s. 156(2) of the Forest Act, did not have a right to the assistance of counsel for advice in pro­cedural or any other matters - The appel­lants alleged bias - The British Columbia Court of Appeal held that this was not an apprehension of bias case, because the alleged bias here was not against the deci­sion maker (the Board), but against the process itself - Further, the allegation of bias was premature - See paragraphs 20 to 31.

Boards and tribunals - Powers - To retain counsel - The British Columbia Court of Appeal held that an Appeal Board appointed under s. 156(2) of the Forest Act, like any other administrative tribunal, had the power to retain counsel for advice providing the role of counsel was "consist­ent with the principles of fairness and natural justice" - The court affirmed that the retainer of counsel at the Board's request to assist in the proper conduct of the hearing was a question of procedure for the Board in respect of the exercise of its statutory jurisdiction - See paragraphs 10 to 19.
