OVERSEAS
APPLICATION
FOR
LANDING:
THE
FAMILY
CLASS
One of the
primary objectives
of
immigration law, identified
in
section
3(c)
of the
Immigration Act,
is to
facilitate
the
reunion
in
Canada
of
cit-
izens
and
permanent residents with their close relatives
from
abroad.
This policy
is
realized
by
permitting Canadian citizens
and
permanent
residents,
who are at
least nineteen years
of age and who
reside
in
Can-
ada,
to
sponsor
the
application
for
landing
of
those close relatives
who
meet
the
criteria
of
membership
of the
family
class. Family-class immi-
grants
are not
required
to
meet
the
selection criteria imposed
on
inde-
pendent
immigrants.
A.
ELIGIBILITY
Section
2 of the
Immigration Regulations defines
a
member
of the
family
class
as
follows:
"member
of the
family
class",
with
respect
to any
sponsor,
means
(a)
the
sponsor's
spouse,
(b)
the
sponsor's
dependent
son or
dependent daughter,
(c)
the
sponsor's
father
or
mother,
(d)
the
sponsor's
grandfather
or
grandmother,
(e)
the
sponsor's brother, sister, nephew, niece, grandson
or
granddaugh-
ter,
who is an
orphan
and is
under
19
years
of age and
unmarried,
(/)
the
sponsor's
fiancee,
