Summary:

A police constable was arrested and charged with shoplifting. The chief of police assigned an investigator to conduct an inter­nal investigation. The investigator recom­mended the constable's dismissal. The disci­pline charge was adjourned pending disposi­tion of the criminal charges. After the Police Act was amended, the constable applied to the police complaint commissioner to have the discipline charge recharacterized as a public trust complaint instead of an internal discipline complaint. The police complaint commissioner sought production of the records relating to the allegations of miscon­duct against the constable and against another constable who was under investiga­tion for alleged neglect of duty. The chief of police denied that the police complaint commissioner had jurisdiction to deal with the matters.

The British Columbia Supreme Court held that the police complaint commissioner was empowered under the Police Act to require the chief of police to produce the records.
