Summary:

The accused pleaded guilty to defrauding her employer of a sum of money exceeding five thousand dollars ($199,838.48).

The Saskatchewan Court of Queen's Bench sentenced the accused to 30 months' imprisonment and ordered her to pay restitution of $199,838.48. The court also imposed a victim impact surcharge of $100.

Punishments (sentence) - Restitution - When appropriate - The 29 year old accused pleaded guilty (after the preliminary inquiry) to defrauding the real estate brokerage that employed her of a sum of money exceeding five thousand dollars - Over a period of two years and 10 months, the accused defrauded the brokerage of $199,838.48 - The fraud involved over 150 separate transactions - The viability of the brokerage was directly threatened - There were also devastating personal consequences on the owners of the brokerage - Despite opportunities to apologize and the ability to make partial atonement, the accused did neither - She concealed and destroyed records related to the fraud - Motivated by greed - She did not accept responsibility - Her lack of honesty continued after the offence by, inter alia, providing false information to the author of the presentence report - She was the mother of a four year old child - She had no plans for the child's care should she be incarcerated - The offence was a serious breach of trust - The Saskatchewan Court of Queen's Bench sentenced the accused to 30 months' imprisonment - The court ordered the accused to pay restitution of $199,838.48, stating that "she is not entitled to just throw up her hands and claim she cannot or will not pay back any money" - The court also imposed a $100 victim impact surcharge - See paragraphs 36 to 82.
