The accused was convicted by a judge and jury of the first degree murder of her two young daughters. She appealed against conviction.
The British Columbia Court of Appeal allowed the appeal and ordered a new trial.

Procedure - Jury - Evidence - Deliberations - Testimonial documents - A mother charged with murder disclaimed criminal responsibility because she suffered from a mental disorder at the relevant time under s. 16 of the Criminal Code - A defence psychiatrist referred in his testimony to his own written report, plus information in reports of the mother's former psychiatrist, not a witness - Neither reports were entered into evidence - The jury requested the reports two hours into deliberating - The trial judge dismissed the request, without offering assistance, advising they were not entitled to reports not put into evidence - The British Columbia Court of Appeal held that the judge's reply failed to advise of the right to have evidence read back and urge the jury to reformulate their request to reflect the real problem - See paragraphs 14 to 36.
