Summary:

The accused was charged with theft and breach of probation. The Crown alleged that she stole a bottle of Tylenol from a grocery store. At the time, she was bound by a probation order (for the offence of theft) which required that she keep the peace and be of good behaviour.

The Newfoundland and Labrador Provincial Court, in a decision reported at [2015] Nfld. & P.E.I.R. Uned. 38, convicted the accused of both offences.

The Newfoundland and Labrador Provincial Court sentenced the accused to a total of 21 days' conditional imprisonment and ordered her to pay a $100 victim surcharge in relation to each count.

Sentence - Theft - The accused was convicted of theft and breach of probation - She stole a bottle of Tylenol from a grocery store - At the time, she was bound by a probation order (for the offence of theft) which required that she keep the peace and be of good behaviour - She had two prior convictions for breaching court orders - The Newfoundland and Labrador Provincial Court sentenced the accused to seven days' imprisonment for theft, plus 14 days' imprisonment for breach of probation (total 21 days) (consecutive sentences to reflect the separate criminality involved in the two offences) - The court made the sentence conditional - Based upon the nature of the offences, the court was satisfied that the accused did not constitute a danger to the public - Further, a conditional sentence would not be inconsistent with the fundamental principles of sentencing given the minor nature of the theft.
