Summary:
The accused appealed his conviction for possession of a narcotic contrary to s. 3(2)(a) of the Narcotic Control Act, R.S.C. 1985, c. N-1. The accused submitted that he was subjected to an unreasonable search and seizure contrary to s. 8 of the Charter of Rights and Freedoms and that the evidence obtained should be excluded under s. 24(2) of the Charter.
The Nova Scotia Supreme Court, Appeal Division, dismissed the appeal. The court held that the accused failed to prove a denial of his s. 8 Charter rights.
