Punishments (sentence) - Conditional sentence - When available or appropriate - The accused was convicted of two counts of fraud against her employer, Atlantic Fundraising Inc., a company established by a group of charities - The accused had misreported winners from break open tickets (loss quantified at $66,070) and had opened tickets and taken prizes for herself (loss difficult to quantify) - 48 years old - No prior record - The accused denied committing the offences, expressed no remorse, and stated that she would not comply with a restitution order - The Newfoundland and Labrador Supreme Court, Trial Division, sentenced the accused to 12 months' imprisonment and two years' probation and ordered restitu­tion of $66,070 - The court considered, inter alia, the serious breach of trust - The court declined to impose a conditional sentence - Given the accused's failure to accept responsibility and her assertion that she would not comply with a restitution order, the court was uneasy about whether a conditional sentence would accomplish the goals of deterrence and denunciation and whether the accused would abide by all terms and conditions imposed on her.
