Summary:

The Newfoundland and Labrador Provincial Court, in a decision reported at (2014), 357 Nfld. & P.E.I.R. 289; 1109 A.P.R. 289, found the accused guilty of assault with a weapon (beer bottle).

The Newfoundland and Labrador Provincial Court suspended the passing of sentence and placed the accused on supervised probation for 12 months. The accused also had to provide DNA samples and pay a $100 victim surcharge

Sentence - Assault with a weapon or assault causing bodily harm - The accused was found guilty of a charge of assault with a weapon, which was prosecuted summarily - While on a crowded dance floor, the accused was pushed from behind by some person other than the victim - The accused responded by swinging her arm back behind her, without having checked to see who was behind her - At the time, the victim was crossing the dance floor - The accused had a beer bottle in her hand - She struck the victim with the beer bottle, causing an injury which required sutures inside and outside her mouth, and which might require cosmetic surgery in the future - The accused immediately apologized to the victim - The accused was a 20 year old first offender - She had been intoxicated on the night of the incident, but had abstained from alcohol since - She accepted responsibility and expressed remorse - The pre-sentence report was positive - The Newfoundland and Labrador Provincial Court suspended the passing of sentence and placed the accused on supervised probation for 12 months - The accused also had to provide DNA samples and pay a $100 victim surcharge.
