An accused applied for an order to quash a count on an indictment. The Alberta Court of Queen's Bench dismissed the application.

Procedure - Indictment - Amendment - Adding counts disclosed by evidence taken at preliminary inquiry - An accused was charged with one count in an information - At the preliminary inquiry, the accused was committed for trial - The Crown prepared an indictment containing two counts - The accused objected to the second count on the ground that a preliminary inquiry had not been held - The Alberta Court of Queen's Bench held that there were sufficient grounds introduced at the first preliminary inquiry to justify the Crown including the second count in the indictment - See paragraph 36.
