Summary:

Butler and an employee were charged with numerous obscenity counts relating to maga­zines, videos and various sexual parapher­nalia.

The Manitoba Court of Queen's Bench, in a decision reported 60 Man.R.(2d) 82, con­victed the accused on several counts. The court acquitted the accused on counts where the material reflected consensual activity between adults without force or violence. The court stated that limitations on such activity imposed by the Criminal Code were not justified under s. 1 of the Charter. The Crown appealed Butler's acquittals. The accused appealed convictions and sentence.

The Manitoba Court of Appeal, Twaddle and Helper, JJ.A., dissenting, allowed the Crown appeal and dismissed the accuseds' appeals against conviction.

Freedom of speech or expression - Limi­tations on - Regulation of distribution of adult publications - An accused was charged with numerous obscenity counts relating to magazines, videos and various sexual paraphernalia under s. 159 [now s. 163] of the Criminal Code - The accused alleged that the section conflicted with the right to freedom of expression in s. 2(b) of the Charter - The Manitoba Court of Appeal stated that the correct approach was to inquire whether the section con­flicted with the right to freedom of ex­pression; if so, then the legislation could be struck down in whole or in part unless saved by s. 1 of the Charter as a reason­able limit - See paragraphs 6 to 7.
