Summary:
The applicants were part of a larger group of accused charged with conspiracy to commit an indictable offence and with belonging to a criminal organization. They were in custody at a remand centre. The Crown made disclosure of its case on CD ROM. Facilities were provided at the remand centre to access the material. The accused applied for an order requiring the Crown to provide hard copy of the material.
The Alberta Provincial Court allowed the application.

General Principles - Rights of accused - Right to discovery or production - The applicants were charged with, inter alia, conspiracy and all were in custody - Crown disclosure was on CD ROMs - The accused argued that the CD ROMs were difficult to access in remand and that they could not print - The Crown argued that it had met its disclosure obligations - The accused applied for an order requiring the Crown to provide hard copy -The Alberta Provincial Court allowed the application - Access to CD ROM was limited in the remand facility and the inability to print was a significant impairment - The charges were serious and all of the accused should have been able to examine the Crown's case - Disclosure here meant hard copy documents had to be provided.
