Summary:

An accused was charged with first degree murder. The accused applied for interim release.

The Alberta Court of Queen's Bench, in a decision reported at [1999] A.R. Uned. 685, dismissed the application. The accused obtained leave to have the Court of Appeal review the decision (see 237 A.R. 355; 197 W.A.C. 355).

The Alberta Court of Appeal, Berger, J.A., dissenting, affirmed the decision to deny interim release.
