Summary:

The accused was charged with conspiracy to import narcotics (cocaine) into Canada. A voir dire was held to determine the admissi­bility of certain wiretap evidence that the Crown sought to use at trial.

The Alberta Court of Queen's Bench ruled that the wiretap evidence was admis­sible at trial.

Garofoli et al. (1990), 116 N.R. 241 and ruled that the wiretap evidence was admis­sible - The court stated that the authoriz­ing judges, on the affidavits submitted to them in support of the authorizations, could have been sat­isfied that the require­ments of s. 186(1) of the Criminal Code had been met.
