Summary:

The accused was charged with six counts of sexual offences, namely, gross indecency, indecent assault, illicit sexual intercourse, sexual intercourse with a person under age 14 and rape (sexual assault). The accused was convicted of gross indecency, sexual intercourse with a person under age 14 and sexual assault. Conditional stays were entered on the other three counts. The accused appealed against conviction.

The British Columbia Court of Appeal, Williams, J.A., dissenting, in a decision reported in 72 B.C.A.C. 227; 119 W.A.C. 227, dismissed the appeal. The accused appealed.

The Supreme Court of Canada dismissed the appeal.

Procedure - Information or indictment, charge or count - Indictable offences - Severing counts in an indictment - The accused was charged with five counts of sexual offences re­specting one complainant and a sixth count of sexual assault against a second com­plainant - The accused was compelled to testify on the first five counts because of the defence's inability to have an inculpatory statement of the accused excluded - The straightforward testimony of the second complainant compelled the accused to testify on the sixth count - The Supreme Court of Canada affirmed that the trial judge did not err in refusing to sever the sixth count from the others - The trial judge did not act unjudicially, nor did the ruling result in an injustice.
