Résumé:

The accused pleaded guilty to breaking and entering in a dwelling house with intent to commit an indictable offence therein, namely, mischief, and aggravated assault. The victim was his ex-girlfriend.

The New Brunswick Court of Queen's Bench, Trial Division, sentenced the accused to six years and nine months in jail for the aggravated assault plus six months consecutive for the break and enter less a credit of nine months for four and one half months spent in remand, leaving a balance of six years and six months to be served.

Sentencing - Considerations on imposing sentence - Deterrence - On March 24, 2009, the 24 year old male accused, who was unhappy with access arrangements respecting his and the victim's daughter, broke and entered into the victim's house and tore the phone from the wall - The police arrived at that point - On May 15, 2009, with the purpose of scaring and scarring the victim, the accused doused her with gasoline and attempted to set her on fire with a lighter - His attempt failed when the victim broke the lighter - The accused pleaded guilty to breaking and entering in a dwelling house with intent to commit an indictable offence therein, namely, mischief, and aggravated assault - The victim filed an impact statement describing her terror and trauma - The accused was a first time offender - The New Brunswick Court of Queen's Bench, Trial Division, sentenced the accused to six years and nine months in jail for the aggravated assault plus six months consecutive for the break and enter less a credit of nine months for four and one half months spent in remand, leaving a balance of six years and six months to be served - In stressing specific and general deterrence, repudiation of conduct and protection of the public, the court (a) considered as mitigating circumstances the accused's guilty plea and his "good" rehabilitation chances, and (b) considered as an aggravating circumstance the fact that the offences were acts of domestic violence - See paragraphs 1 to 68.
