Summary:

A 13 year old girl was lured to a golf course, where she was sexually assaulted and beaten to death. Two adults and three youths were involved. The accused youth (D.D.T.), in a judgment reported [2008] A.R. Uned. 588, was found guilty of second degree murder and aggravated sexual assault. Although she had not participated in the scheme to kidnap the girl, she participated in the beating and helped hold the girl down while she was sexually assaulted. The Crown applied under s. 71 of the Youth Criminal Justice Act to have D.D.T. liable to an adult sentence, arguing that a youth sentence would not be of sufficient length to hold D.D.T. accountable for her offending behaviour.

The Alberta Court of Queen's Bench dismissed the application. The Crown failed to discharge the persuasive burden of establishing that a sentence under the Act would be of insufficient length to hold D.D.T. accountable.

Young offenders - Decisions (incl. punishments) - Adult sentence (incl. place of custody) - In April 2005, a 13 year old girl was lured to a golf course, sexually assaulted and beaten to death - Two adults and three youths were involved - The 16 year old youth (D.D.T.) was convicted of second degree murder and aggravated sexual assault - Although she had no advance knowledge of what was planned, at the direction of others she participated in the beating and helped hold the girl down while she was sexually assaulted - The Crown applied under s. 71 of the Youth Criminal Justice Act to have D.D.T. liable to an adult sentence, arguing that a youth sentence would not be of sufficient length to hold D.D.T. accountable for her offending behaviour - The maximum youth sentence was seven years (four years custody and three years community supervision) - If credit was given for four years' pre-trial custody (court had a discretion not to give credit), D.D.T. would already have served the custodial portion of any youth sentence - The Alberta Court of Queen's Bench dismissed the application - D.D.T. was a follower, not an instigator - She was the youngest and least morally culpable of all those involved - At the time of the offence, D.D.T. was a drug user and a sex-trade worker, resulting from an emotionally, physically and sexually abusive childhood - She was diagnosed as having anti-social personality disorder and borderline personality disorder - Given her multiple psychological issues, she was a high moderate risk to re-offend - She needed long-term individual psychotherapy - The court held that based on "her involvement in the crime, her conviction as a party to the offence as opposed to a key perpetrator, her youth and immaturity, plus her lack of participation in the planning, I conclude D.D.T. can be held accountable within the sentencing regime of the YCJA. Second, based on her positive effort while in the CYOC, including her behaviour, educational achievements, and her expressions of remorse and empathy for the victim and the victim's family, that she is treatable within the upper limits of the YCJA sentence range".
