Summary:

Two young offenders were acquitted in Youth Court of second degree murder. The Crown appealed from the acquittal.

The British Columbia Court of Appeal, Seaton, J.A., dissenting, in a decision report­ed in 28 B.C.A.C. 129; 47 W.A.C. 129, allowed the appeal and ordered a new trial. The young offenders appealed.

The Supreme Court of Canada allowed the appeal, set aside the Court of Appeal's judg­ment, and restored the acquittals.

Appeals - Indictable offences - Grounds of appeal - Question of law or question of law alone - The Crown appealed the acquittal of two young offenders of second degree murder, relying on grounds of appeal allegedly involving questions of law alone, as required by s. 676(1)(a) of the Criminal Code - The case, although strong, was largely based on circumstantial evidence - The trial turned on the reliabil­ity of witnesses and inferences that should be drawn from their evidence - The Supreme Court of Canada agreed that there being no issues which raised questions of law alone, the appeal must be dismissed and the acquittals restored.
