Summary:

Two young offenders were acquitted in Youth Court of second degree murder. The Crown appealed from the acquittal.

The British Columbia Court of Appeal, Seaton, J.A., dissenting, in a decision report­ed in 28 B.C.A.C. 129; 47 W.A.C. 129, allowed the appeal and ordered a new trial. The young offenders appealed.

The Supreme Court of Canada allowed the appeal, set aside the Court of Appeal's judg­ment, and restored the acquittals.

Appeals - Indictable offences - Grounds of appeal - Question of law or question of law alone - The Crown appealed the acquittal of two young offenders of second degree murder, relying on grounds of appeal allegedly involving questions of law alone, as required by the Criminal Code, s. 676(1)(a) - The British Columbia Court of Appeal, Seaton, J.A., dissenting, allowed the appeal and ordered a new trial - The Supreme Court of Canada restored the acquittal - The court agreed with Seaton, J.A., that it was open to the trial judge to decide that the evidence was insufficient to support a conviction and there was no identifiable error of law alone.
