Summary:

A 31 year old male pleaded guilty to charges of possession for the purpose of trafficking under the Narcotic Control Act and the Food and Drugs Act. The accused was a petty retailer who was obsessed with drugs in his daily existence.

The Newfoundland Provincial Court imposed a two year term of imprisonment followed by three years of probation on the Food and Drugs Act charge. The court also imposed a 16 month concurrent term for the Narcotic Control Act offence.

Sentence - Trafficking in a narcotic (marijuana) - The accused was charged with possession of nine grams of marijuana for the purpose of trafficking under the Narcotic Control Act and possession of 139 hits of LSD for the purpose of trafficking under the Food and Drugs Act - Accused was 31 years of age, unmarried and unemployed and had a number of convictions under the Narcotic Control Act - The Newfoundland Provincial Court imposed a term of imprisonment of two years and three years' probation on the Food and Drugs Act charge - The court also imposed a 16 month concurrent sentence on the Narcotic Control Act offence - See paragraph 23.
