Summary:

The accused pleaded guilty to luring a child over the internet for a sexual purpose. The Crown sought 15-18 months' imprisonment. The accused sought a conditional sentence.

The Alberta Provincial Court sentenced the accused to 15 months' imprisonment followed by three years' probation.

Sentence - Luring a child (by means of computer) - The 28 year old accused pleaded guilty to luring a child over the internet for a sexual purpose - The accused invited 13-16 year old girls wanting to make money to contact him at an email address - In a series of emails with an undercover officer pretending to be a 16 year old girl, the accused offered to pay $200 for sexual services - He had prior convictions for sexual interference (three year old nephew), breach of probation (failure to attend sex offender counselling) and two counts of assault (both sexually motivated) - He had substance abuse and mental health problems, including depression, and was assessed as a high risk to re-offend sexually without treatment and counselling for his depression, self-isolation and poor stress management - Aggravating factors included the planned and deliberate predatory targeting of young vulnerable girls and his preference for young girls, although he was not diagnosed as a paedophile - Mitigating factors included an immediate confession of guilt, his continued counselling and treatment, the stability of his current relationship and compliance with all conditions of his bail for the past 20 months - The Crown sought 15-18 months' imprisonment - The accused sought a conditional sentence - The Alberta Provincial Court sentenced the accused to 15 months' imprisonment followed by three years' probation - A conditional sentence was not appropriate, as it would endanger the safety of the public and/or would be inconsistent with the fundamental purposes and principles of sentencing.
