Summary:

The accused was convicted of aggravated assault and breach of probation.

The Newfoundland and Labrador Provincial Court sentenced the accused to six months' imprisonment for the aggravated assault and one month of consecutive imprisonment for the breach of probation. The court also imposed two years' probation, a DNA order and a 10 year firearms prohibition.

Sentencing - Considerations on imposing sentence - Mental state - Effects of alcohol or drugs - The Newfoundland and Labrador Provincial Court, in determining a fit sentence for an accused, stated that "Some factors, such as alcohol addiction, have both positive and negative features. An alcoholic offender in a community where, for example, alcoholism is a major symptom of cultural and linguistic alienation, where more people are alcoholics than elsewhere, and where the individual and the community have made efforts to face this problem through treatment programs may receive some understanding from a sentencing judge. Alcoholism and voluntary drunkenness is, of course, not a defence to a criminal charge, and may indicate to the sentencing judge recklessness and disregard for the dignity and respect an offender owes to others in the community." - See paragraph 30.

Sentencing - Considerations on imposing sentence - Aboriginal offenders - The accused, a 20 year old aboriginal, was convicted of aggravated assault and breach of probation - In his youth, he was falsely charged with sexually assaulting a group of six young girls - The accused and the victim had a history of arguments - On the day in question, the victim called the accused a child molester - The accused pushed his bicycle into the victim - They exchanged punches - The accused tried to flee - The victim chased after him and grabbed him by the head - The accused stabbed the victim in the left chest with an unidentified object - The victim was hospitalized for two weeks - The accused had 16 prior convictions for minor offences - Had a dysfunctional childhood - Dropped out of school in Grade 8 - Had one daughter - Separated from the daughter's mother - Despite limited employment experience, he had an offer of work from the Mushuau Innu First Nation - He wanted to finish school and become a hockey coach - Supported by his sister - Had applied for a treatment program - The Newfoundland and Labrador Provincial Court considered, inter alia, the Gladue principles and the mitigating factors of provocation and self-defence, and sentenced the accused to six months' imprisonment for the aggravated assault and one month consecutive for the breach of probation - The court gave the accused 99 days' credit for 66 days of pretrial custody, resulting in 101 days left to be served - The accused was entitled to 1.5:1 credit given the loss of remission time - No submission was made for mitigation based on oppressive, onerous, unfair or demeaning conditions or treatment, but if it had been a feature of the case there would have been strong arguments given the severe overcrowding at the Labrador Correctional Centre - The court also imposed two years' probation and ancillary orders - See paragraphs 154 to 265.
