Summary:

The accused was convicted of manslaugh­ter and sentenced to 15 years' imprisonment. He appealed his conviction on the ground that he did not use excessive force to defend himself and his property in the face of forc­ible entry of his home. He also appealed sentence.

The Alberta Court of Appeal, Foisy, J.A., dissenting, in a decision reported 149 A.R. 59; 63 W.A.C. 59, allowed the appeal and quashed the conviction. The Crown appealed.

The Supreme Court of Canada, in a deci­sion reported 174 N.R. 161; 162 A.R. 117; 83 W.A.C. 117, allowed the appeal and remitted the sen­tence appeal to the Court of Appeal.

The Alberta Court of Appeal subsequently allowed the sentence appeal and substituted a sentence of 12 years' imprisonment.

Sentencing - Considerations on imposing sentence - Mental illness - A 59 year old accused suffering from irreversible organic brain damage was convicted of man­slaughter - He was sentenced to 15 years' imprisonment - The Alberta Court of Appeal, while noting that the offence was at the high end of the spectrum for man­slaughter (a near-murder), reduced the sentence to 12 years' imprisonment "[g]iven the psychiatric overtones here ...".
