A summary conviction court convicted the accused of having the care and control of a motor vehicle while his blood-alcohol content was excessive. The accused appealed.

The Alberta Court of Queen's Bench dismissed the appeal.

Right to counsel - General - Denial of -Due to lack of time or opportunity - A constable arrested the accused for impaired driving - At a nearby police detachment, the accused was given the use of a phone room so he could contact a lawyer - The accused was unsuccessful in reaching the lawyer of his choice, a Mr. Tralenberg - The constable told the accused that it would be best for him to phone a lawyer - The accused did not contact a lawyer - He supplied breath samples, as requested by the constable - The trial judge admitted the breath test results by way of a certificate - The judge held that when it became clear that Mr. Tralenberg was not going to be contacted, the accused chose to provide the breath samples without the advice of counsel - The judge added that, although the constable committed a "technical" breach of s. 10(b) of the Charter by not telling the accused that the police would hold off taking statements or requiring the accused to participate in anything until he had reasonable time to contact a lawyer, this "technical" breach could not ground a successful s. 24(2) application to exclude the breath sample evidence - The accused was convicted - The Alberta Court of Queen's Bench upheld the decision.
