Summary:

The accused was charged with second degree murder. Following a preliminary inquiry the Provincial Court judge held there was insufficient evidence to convict on the murder charge, but ordered that he stand trial on the included offence of manslaughter. Subsequently, the Attorney General preferred an indictment charging the accused with second degree murder. The accused applied to quash the second degree murder indictment, arguing, inter alia, that a preferred indictment could not be laid against him where he was not discharged at preliminary and the laying of the indictment violated his s. 7 Charter rights (i.e. was contrary to the principles of fundamental justice).

C-34, ss. 504(1), 507) - The Saskatchewan Court of Queen's Bench disagreed that the Attorney General lacked authority to prefer such an indictment under ss. 504(1) and 507 - The court held in any event, that the committal for trial for manslaughter constituted a discharge for the second degree murder offence - See paragraphs 1 to 15.
