Summary:

The accused was charged with unlawful entry under s. 349(1) of the Criminal Code and assault with a weapon under s. 267(a). He was released on an undertaking with conditions. He subsequently appeared in Provincial Court and pleaded not guilty and a trial date was set. Prior to the trial date he appeared in court with counsel seeking to change the release conditions. The Crown was not prepared to consent and argued that the Provincial Court judge had no jurisdiction to proceed to hear the application.

The Nova Scotia Provincial Court held that it had no jurisdiction to consider the accused's application unless the Crown consented.

Compelling appearance, detention and release - Interim release or detention of accused pending trial or appeal - Vacating, cancelling or varying interim release order - The accused pleaded not guilty in Provincial Court to two criminal offences and was released on an undertaking with conditions - Prior to the trial date he appeared in court with counsel seeking to change the release conditions - The Crown was not prepared to consent and argued that the Provincial Court judge had no jurisdiction to proceed to hear the application - The Nova Scotia Provincial Court held that there were three situations where a provincial court judge did not require Crown consent before proceeding to hear an accused's application to change release conditions; however, this was not one of those situations and thus the court had no jurisdiction to consider the accused's application unless the Crown consented.
