Summary:

A 15 year old youth and an 18 year old adult were charged with first degree murder. The Crown applied under s. 16 of the Young Offenders Act for an order transferring the proceedings involving the youth to adult court.

The Alberta Provincial Court, Youth Division, in a judgment reported 68 A.R. 94, allowed the application and transferred the proceedings to adult court. The youth appealed.

The Alberta Court of Queen's Bench allowed the appeal and reversed the order of the Youth Court.

Young offenders - Transfer out of youth court - Considerations - For good of child or community - Young Offenders Act, S.C. 1980-81-82, c. 110, s. 16 - A 15 year old youth and an 18 year old adult were charged with first degree murder - The proceedings against the youth were transferred from the Youth Court to adult court - If convicted in adult court, the youth faced life imprisonment without eligibility for parole for 25 years - Under the Young Offenders Act the maximum disposition was three years - The youth was a normal 15 year old who was a follower of the 18 year old adult - There was no need for imprisonment for longer than three years - The limited punishment under the Young Offenders Act was adequate - The Alberta Court of Queen's Bench reversed the order transferring the youth to adult court, because it was in the "interests of society and having regard to the needs of the young person", better that the youth be tried in youth court.
