A physician/anaesthetist was charged with assaulting a patient contrary to s. 266(b) of the Criminal Code.

The New Brunswick Provincial Court convicted the accused and sentenced him accordingly.

Offences against person and reputation - Assaults - Simple assault - What consti­tutes - A 59 year old physician/anaesthe­tist was charged with assault - The victim was a 93 year old male mental patient who was often con­fused and disoriented - The patient was vocal and yelled and hollered at times, but was not a threat to himself or others - The assault occurred after the doctor inserted a needle into the sleeping patient's hand - The patient moved and the needle came out, then he hollered - The doctor struck the patient's face twice, once with a closed fist - The doctor was charged with assault - The doctor denied hitting the patient - The doctor claimed he was just turning the patient's head and attempting to startle him - The New Brunswick Provincial Court convicted the doctor - See paragraphs 1 to 35.
