Summary:
The driver of a motor vehicle was stopped for speeding by a peace officer. When asked to identify himself, he gave another person's name and was subsequently issued a speeding ticket under that name. The driver was convicted of obstructing a peace officer contrary to s. 118(a) of the Criminal Code. The driver appealed.
The Saskatchewan Court of Queen's Bench held that the driver intended to mislead the peace officer and did so, thereby obstructing the peace officer in enforcing the provisions of the Vehicles Act. For other charges arising from the incident see R. v. Johnson, 41 Sask.R. 207.
