Summary:
The accused was charged with first degree murder arising out of the killing of his friend. The accused pleaded not guilty by reason of mental disorder under s. 16(1) of the Criminal Code.
The British Columbia Supreme Court reviewed s. 16(1) which required that the accused establish that he suffered from a mental disorder that rendered him incapable of appreciating the nature and quality of his acts or of knowing that these acts were wrong. The court reviewed the psychiatrists' evidence and found the accused not criminally responsible by reason of mental disorder.
