Summary:
The accused were charged with possession of cocaine for the purpose of trafficking.
The New Brunswick Provincial Court acquitted them on finding that the element of possession was not proved.

Offences - Possession - Constructive possession - Keleher rented an apartment - Green and Molasky were observed using it on an evening - From police observation of their activities, cocaine in baggie corners was found in the woods and matching baggies were found in the apartment - During the raid Molasky was seen flushing white packets down the toilet - The New Brunswick Provincial Court acquitted the three of possession of cocaine upon finding that the evidence did not establish their possession of the cocaine in the woods.
