Summary:

The accused pleaded guilty to trafficking in cocaine (Controlled Drugs and Substances Act, s. 5(1)) and failing to stop his motor vehicle while being pursued by a police officer in attempt to evade the officer (Criminal Code, s. 249.1(1)).

The Alberta Provincial Court, in a judgment reported (2005), 378 A.R. 254, sentenced the accused to five months' imprisonment for attempting to evade police, followed by a 17 month conditional sentence for trafficking in cocaine (first 12 months under house arrest). The court also imposed a five year driving prohibition. The accused appealed the five month sentence for evading police and the driving prohibition.

The Alberta Court of Queen's Bench allowed the appeal in part. The court affirmed the five month sentence, but reduced it to time served (equivalent of three months). Given that the accused was a first time offender and had effectively spent 2.5 years under a driving prohibition, the court reduced that prohibition to one year.

Punishments (sentence) - Prohibition orders - Respecting driving of motor vehicle - The 22 year old accused associated with the "wrong crowd", incurred large gambling debts, and, needing money, sold one gram of cocaine to an undercover officer for $80 - Police officers attempted to stop the accused's vehicle as he left the scene - The accused attempted to evade them in a high speed chase, running a red light and four stop signs and narrowly missing several civilian vehicles, before finally striking another vehicle in a residential neighbourhood - The accused had no prior criminal record, family support, stable employment and no substance abuse or psychological problems - He was assessed as being a low risk to reoffend - The trial judge sentenced the accused to five months' imprisonment for evasion, followed by a 17 month conditional sentence for trafficking - A conditional sentence, although appropriate for trafficking, was not appropriate for evading police - The first 12 months were under house arrest, with a curfew for the remaining five months - Additionally, the court imposed a five year driving prohibition - The accused appealed the five month evasion sentence and the driving prohibition - The Alberta Court of Queen's Bench affirmed the five month sentence for evasion, but reduced it to time served (equivalent of three months) due to extenuating circumstances - The court reduced the driving prohibition to one year, where the accused was a first offender and had already been subjected to the equivalent of a 2.5 year prohibition.
