Restricted drugs - Trafficking - What constitutes - The accused was convicted of possession of LSD for the purpose of trafficking contrary to s. 42(2) of the Food and Drugs Act - The accused purchased 350 doses of LSD for himself and four others - The accused contributed $200.00 to the purchase price of $650.00 - The accused appealed his conviction on the ground that his intention to share the drug with the others according to their monetary contributions did not amount to trafficking - The Alberta Court of Appeal dismissed the appeal and held that transporting or delivering the drug to his friends was trafficking within s. 40 of the Food and Drugs Act - See paragraphs 7 to 34.
